Being in an accident is an experience that no motorist wants to have. The telltale sounds of an accident – the screeching tires, crunching metal, and breaking glass –are straight from every driver’s worst nightmares. In the moments immediately preceding the impact, the driver and vehicle occupants may wonder if they will see their loved ones again or if they will be able to do the things that they loved after the accident. In short, vehicular accidents are life threatening and life changing events where, even when the victims escape with relatively minor physical injuries, an immense emotional and psychological toll can be observed.

When the accident involves a large commercial vehicle transporting thousands of pounds of retail goods, merchandise or other cargo the accident is typically more severe. The Law Practice of Ken Kieklak is dedicated to standing up for hard-working Arkansans seriously injured in commercial trucking accidents. We handle every step of the process including the insurance company and their lawyers.

Why do commercial trucking accidents occur?

Each and every accident is unique. They are a product of factors coming together until a collision or other incident is unavoidable. However certain factors increases the likelihood of an accident occurring. These factors include:

    • Adverse weather conditions – Snow, sleet, ice, rain and high winds can all act as major factors in bringing about an accident. Conditions like these can increase stopping distances and reduce visibility. In the case of severe winds, trucks may inadvertently veer from lane-to-lane necessitating that other drivers take immediate evasive action. In short, slowing down or refraining from driving during severe weather events can decrease the likelihood of being involved a commercial trucking accident.
    • Improperly secured cargo – Federal Motor Carrier Safety Administration (FMCSA) defines and publishes the standards and requirements commercial carriers must follow. Unfortunately, not every motor carrier adheres to these standards. Some carriers may fail to follow these standards at an organizational level. In other instances the failure may be due to a driver who is looking to make better time or who otherwise does not follow the securement rules.
    • Distracted driver – A distracted driver is one that does not perceive dangers and threats as quickly as he or she should. Because the driver’s detection of a threat is delayed, their corrective or evasive action is also delayed. Regardless of whether the distraction is due to using a mobile phone, operating a radio, reading a map, or for other reasons a distracted driver is significantly more likely to cause an accident.
    • Fatigued driver – Tiredness and fatigue reduces the information processing and threat detection capabilities of a driver. Fatigued drivers make decisions more slowly and generally face an increase collision risk. FMCSA has set forth hours-of-service rules intended to reduce distracted driving, but those standards have faced criticism by trucking industry representatives and they are unlikely to remain in effect.
    • Driver didn’t see vehicle – Trucks are large vehicles that few individuals could miss. The same cannot be said for the lower profile of a motorcycle or a compact car. These vehicles can be missed by a distracted driver much more easily. When a driver fails to see another vehicle and enters traffic, a collision becomes likely.

The above represents only some of the more common factors involved in a trucking accident. Accidents involving 18-wheelers, Mack Trucks, box trucks, and other large commercial vehicles can occur for a broad array of reasons.
